Koenig Speaks at Feb. 22 Guardianship CLE

Philip E. Koenig delivered an hour-long talk in Chicago on Feb. 22, 2013,  on “Inventory, Annual Reports and Fiduciary Accountings” at a “Guardianship Boot Camp” continuing legal education seminar. The CLE event took place at the Illinois State Bar Association regional office at 20 N. Clark St.

The full-day program was designed to help attorneys master the basics of administering a guardianship.

Koenig’s talk helped the attendees gain a better understanding of what should be included in an inventory, annual report, and fiduciary account. He offered an overview of the investment requirements and fiduciary accountings, the allocation of expenses under the Principal and Income Act, and the necessary procedures for handling objections.

The day also featured presentations addressing the following topics:

  • Who qualifies as a disabled person and why a guardian may be necessary;
  • Types of guardianship estates and who may serve as a guardian;
  • The guardianship appointment process;
  • Requirements for opening and closing the guardianship estate;
  • The powers, duties, and limitations of the guardian;
  • Contested guardianships and how to avoid and/or settle them;
  • The roles of the Public Guardian and Office of State Guardian; and
  • The ethical issues to consider when acting as Power of Attorney.

Other attorney speakers – all from Cook, DuPage and Will counties – were Bryan R. Mason, Cameron R. DeGuerre, Deborah B. Cole, Gregg A. Garofalo, Ray J. Koenig III, Edward J. Jarot Jr., and John Dirk Gutzke.
